Supreme Court rules Section 53 unconstitutional

By Aaron Humes: Chief Justice Kenneth Benjamin today found that Section 53 of the Criminal Code which criminalizes consenting intercourse between adults of the same sex contravenes the right granted by the Constitution of Belize to no interference with a person’s dignity and personal privacy, as well as equality and equal treatment of all persons before the law.

So finding, he added that the court has an obligation to amend the law to bring it in conformity with the Constitution, and ordered an amendment specifying that the section does not apply to consenting sexual acts between adults of the same gender.

In delivering the long-awaited 100-plus minute ruling, the Chief Justice repeated that the court could consider, but could not act on majority and publicly held views, particularly religious views.

The Chief Justice also accepted that removing the section would help accelerate the fight against HIV, especially among men who have sex with men (MSM), who are stigmatized and thus refuse to participate in testing and treatment programs.

    Joe Grind, pedophilia (religious and otherwise), incest, and statutory rape seem to be far greater social issues in Belize that need addressing than the sexual lives of consenting adults. Consent means just that. Without it, it is rape and that is how it should be handled through the legal system.

    All I know is that procreation will never occur between two men or two women as a matter of fact. The problem with our society today is we are all a bunch of followers,seemingly unable to decide for ourselves the difference between right and wrong. Whatever these demons put on tv,and call cool us as a people swallow hook line and sinker. Say yuh pants, we oblige. Men dressing as women and acting accordingly no problem. We down with dat shit also. Where do we draw the line? As a people we should be ashamed of our collective selves.
    This pattern of behavior we’re adapting is seen nowhere else in nature except among humans. Sad day for us when we as the smartest ones on the planet can’t figure it out.

    Tragic ruling for BELIZE.Not surprising though in a system in which murderers get acquitted only to commit murder, serve a short sentence, released only to be arraigned for murder the third time!

    There are many developing countries that have rejected the promise of development aid from the US which is sponsoring the legitimization is sodomy internationally in return for aid under the guise of privacy, self-determination and freedom.

    Professionals know that there is nearly always a double digit % variance between reported and unreported HIV cases. The moral decadence and socio-economic underpinings of the current HIV rates are downplayed and many are in denial of the true rates.

    Gnashing of teeth or not, this generation of teethgnashers would soon be decimated by natural ageing and the evil that the chiefest enemy of Belize future in the person of justice Kenneth Benjamin has done , will live after him when he goes to face the judgement of the creator who made man and woman for procreation and as standard of conjugal normality among humans.

    The GOB should challenge gay benjamin’s ruling and call for a referendum instead.
