Tuesday, June 17, 2014. AARON HUMES Reporting: Today 42 year old tattoo shop operator Gerald Dawson, originally of Caye Caulker but now residing in Orange Walk Town, was acquitted of indecent assault against a 13 year old girl.
On May 23, 2013 he was accused of biting the girl’s neck during a sexual encounter at a local basketball court.
The owner of Art-Ink Sanity said he was innocent of the charge but was forced to move from the island and close his business because of notoriety.
But the case fell apart at trial when the complainant admitted under cross-examination by attorney for Dawson Kathleen Lewis that she lied in her first statement to police.
She insisted that in a second, subsequent statement to police she told the truth, but it was established that the two statements were virtually the same.
The arresting officer, also under cross-examination, told the court that he disbelieved the complainant’s statements.
The primary school student was allegedly beaten by her mother after the incident until she told her that Dawson was the man who bit her.
It was alleged that the two had conversed over the social networking site Facebook but no evidence of this was presented in court.
Chief Magistrate Ann-Marie Smith upheld the submission of no case to answer by Lewis, ruling that there was “difficulty and inconsistencies” in the prosecution’s case, especially with the complainant, who she said was not credible.
Dawson says that with the charge now behind him, he wants to go back home.
