Emory Felix and Maurice Felix murder charges dropped

Wednesday, July 23, 2014. AARON HUMES Reporting:  The Office of the Director of Public Prosecutions on Tuesday formally and quietly filed a notice of nolle prosequi against brothers Maurice and Emory Felix.

Officially, it means the case is being dropped for lack of evidence but can be brought back at a later date if that evidence is found. However in practice that is rarely the case.

Maurice, 30, and Emory, 27, had been on remand for the murder of Mitchum Heredia since 2006 and faced three trials.

The first resulted in their conviction, which was overturned on appeal at the Court of Appeal.

The second, before a different judge, ended with the jury unable to reach a verdict.

The most recent try, before Justice Troadio Gonzalez in Corozal, ended this past May when that jury was deadlocked after six hours in deliberation.

They have maintained their innocence throughout and claimed that they were at home at the time of the murder in April 2006.
