Guillermo Silva free of rape charges after accuser refuses to testify

Aaron Humes: Guillermo Silva, 23, was freed on Monday after the representative from the Director of Public Prosecutions’(DPP) office entered a motion of nolle prosequi in a rape charge with a minor.

Silva was arrested and charged after his accuser, a 15 year old minor, gave police a statement saying she had run away from home and gone to Silva’s residence on Antelope Street Extension, where he raped her. A medical examination confirmed the rape.

Silva had been on bail after being remanded on November 3rd, 2015, but on appearing before Supreme Court Justice Collin Williams, he was told that the prosecutors decided to enter the motion after the complainant indicated she did not want to testify against Silva.

The legal term allows for the case to be resumed if other evidence is found, but the complainant’s testimony would be considered crucial to the case as it now stands.

But with nothing else to hold Silva on, he was let go pending further action from the DPP’s office.
