PUP sues PM Barrow for breach of Finance and Audit Reform Act

BBN Staff: The People’s United Party (PUP) informed today that Leader of the Opposition, John Briceño and Chairman of the Public Accounts Committee (PAC), Julius Espat, have filed a suit against Prime Minister of Belize, Dean Barrow and the Financial Secretary for breaching the Finance and Audit Reform Act.    

The PUP filed Supreme Court Claim #142 of 2019 against Prime Minister Barrow as Minister of Finance, Joseph Waight as Financial Secretary and the Attorney General for breach of Section 3 of the Finance and Audit Reform Act.

They contend that all Government spending must be prospective and must come before Parliament before monies are spent and never after, by virtue of Section 114 of the Constitution.

Additionally, the PUP says that expenditures cannot be justified on the basis of being urgent and unforeseen because they were not urgent or unexpected and because the Constitution provides for the creation of a Contingencies Fund from which urgent and unforeseen expenditures must be undertaken.

The Contingencies Fund may be replenished from time to time by way of supplementary appropriations from the Consolidated Revenue Fund.

The PUP says that the Government of Belize has over the past ten years, ignored the Finance and Audit Reform Act and has passed dozens of General Revenue Supplementary Appropriations amounting to $1.3 billion dollars without prior approval of Parliament.
