Daniel Myvett was scheduled to be retried after his first trial in 2015 ended in a hung jury.
But attorney Leeroy Banner told Supreme Court Justice Collin Williams that the court has failed to issue a transcript of the first trial, which is needed for the retrial.
Justice Williams agreed to a permanent stay of proceedings, allowing Myvett to fully go free, never to be tried again for the now nine-year-old murder. He had been out on bail since August of 2018.
Oloungundudu was stabbed to death on the job site during an alleged robbery.
Two other accused, Talbert Mena and Jamaal Jackson, were acquitted in the 2015 trial.
