Minor drops rape case against accused man, 30

By Aaron Humes: She was sexually assaulted at the tender age of nine, but four years on, she has decided to move on and drop her court case against her accuser.

But the Office of the Director of Public Prosecutions is not quite as sure, as it filed a motion of nolle prosequi against now 30 year old Daniel Rios, charged with unlawful sexual intercourse with a child.

Rios appeared before Supreme Court Justice Collin Williams, where the prosecutor informed that the now 14 year old had visited the Police and the DPP’s office indicating that she and her mother did not want further court action against Rios.

But with the option of withdrawing the case, which meant it could not be brought back ever again, the prosecution chose nolle prosequi and hopes to convince the accuser and her parent to proceed. However, the track record even with nolle prosequi cases is that they too are rarely tried again.

The incident was reported to have occurred in April of 2015, and Rios was sent for trial in February of 2016. He is now a free man, but knows that if the accusers change their minds he will face the court once again.
