Eye witness flips the script, accused man walks from second murder charge

By BBN Staff: Belize City resident Jervis Valencia walked free from his second murder charge this week, after the court found several issues with key points in the prosecution’s case including eyewitness testimony.

Valencia was charged with the 2015 murder of Moses Gonguez and at the time, police had a witness who claimed to have seen Valencia enter a yard and fire the shots that killed Gonguez. However, in court the witness completely changed the statement, and said that it was impossible to have seen Valencia commit the murder. Trial Judge Justice Colin Williams also said that he was unsatisfied with the chain of custody for the recovery of the expended shells at the scene, and decided to acquit Valencia.

Valencia had awaited his trial date on remand at the Belize Central Prison, recovering from gunshot injuries inflicted by police on the night of Gonguez’s murder. Police say that they had caught up with Valencia following the shooting and that he pulled out a gun and opened fire on them. He was shot three times during the exchange.

While awaiting his trial date for Gonguez’s murder, he also had a murder case pending against him for which he was acquitted in 2018.
