Australia’s new law makes Google and Facebook pay for news

By BBN Staff: Australia has finalized amendments to new legislation which will require the global companies Google and Facebook to pay for news content, reports the Associated Press.

Following Australia’s passage of the original News Media Bargaining Code, Facebook had blocked Australian news content from its platforms but has said that it will unblock them because the amendments are satisfactory.

The legislation was reportedly designed to address an imbalance in negotiating power that Google and Facebook had when negotiating payment for news content with Australian media companies. Under the new legislation, the companies cannot abuse their positions by making take-it-or-leave-it payment offers media houses. In the event of a standoff in negotiations, the issue would be heard before an arbitration panel which would make a binding decision.

Rod Sims, the competition regulator who drafted the code, said, “The purpose of the code is to address the market power that clearly Google and Facebook have. Google and Facebook need media, but they don’t need any particular media company, and that meant media companies couldn’t do commercial deals.”

CNN notes that the finalization of the law and the subsequent agreement by Google and Facebook now opens the way for other countries to do the same.
