Man charged with stealing over $130,000 from former employer walks free from criminal charges and civil claim

By BBN Staff: This week, Juan Angel Munoz, a former employee of Magil’s Mexican Products Company Limited, walked away a free man, from both criminal charges and a civil claim with respect to  $137,916.46 allegedly stolen back in 2010.

Chief Justice, Madam Michelle Arana handed down the ruling on Monday, saying that Munoz was free of any liability to repay his former employer after a jury of nine had previously freed him of theft charges.

The Chief Justice said that the claimant had failed to prove how much money was actually missing due to major deficiencies in the testimonies of the claimant’s witnesses.

“… neither of these persons had the requisite level of training to provide the quality of evidence which would satisfy this court that that specific amount of money was missing from this company in the first place,” Chief Justice said.

The defendant had also argued that his confession and subsequent promise to repay the missing amount was done under duress and the chief justice said that the claimant failed to adequately address that assertion.

After considering the evidence, both written and oral, the Chief Justice was convinced that Munoz had in fact given the statement under duress, and ordered that the claimant pay his cost of court.
