By BBN Staff: On August 5, Chief Magistrate Sharon Fraser is set to make a determination on the case of 71-year- old, Miguel Mesenguer, the Mexican pilot charged with flying a drug plane onto the coastal Road back in 2019.
The matter is currently in voir dire (trial within a trial) as Mesenguer, represented by attorney Anthony Sylveter, is challenging the caution statement he gave to the police. He told the court that the caution statement was written in English and he speaks exclusively in Spanish. The prosecution has a witness, Superintendent of Police Raymundo Reyes, who testified that Mesenguer gave the statement which expressly said that he was on the narco plane that police seized; however, the validity of the caution statement is now in question.
If the Chief Magistrate is not satisfied with the validity of the statement, it is possible the case would fall apart. Mesenguer was initially detained with seven other men, in connection to the plane, that was carrying almost 3,000 pounds of cocaine, but the others were all charged with immigration offenses and subsequently deported.
