By BBN Staff: Lyndon Kelly, previously charged with the September 8, 2016 stabbing murder of Elton Polonio, 32, in San Pedro; left court a free man yesterday after his case ended in a “nolle prosequi” due to insufficient evidence.
Kelly appeared before Justice Herbert Lord in the Belize City Supreme Court where the office of the Director of Public Prosecution (DPP) informed the court that due to insufficient evidence against Kelly, it was forced to enter a case of nolle prosequi.
Kelly was also informed that due to the nature of the allegation, the trial may once again proceed against him if any evidence is brought forth and charges reinstated.
Kelly was charged on September 12, 2016, for the crime. Polonio was stabbed inside a hardware store on Angel Coral Street on the island. He ran out to the street after being stabbed where he collapsed and died.
