Decision expected on Thursday re government’s application to strike out Stake Bank’s case re cruise ports fiasco

By Aaron Humes: Supreme Court Justice Lisa Shoman is to rule tomorrow morning, Thursday, at 11:00 a.m. on an application to strike out the claim made by the owners of Stake Bank Enterprises Limited against the Attorney General and the National Environmental Appraisal Committee (NEAC) and Department of the Environment (DOE).

Today, arguments were heard on the Government’s position that the Stake Bank claim was not filed within the 14-day limit in the Civil Procedure Rules of the Court.

Stake Bank is represented by attorneys Senior Counsel Glenn Godfrey and William Lindo, Jr., whose clients claim that the Government in the person of the NEAC and DOE improperly gave permission to two other companies, Portico (parent of Port of Magical Belize) and Waterloo Enterprises (parent of Belize Logistics Terminal Limited and its proposed cruise ship port) to operate in violation of an expectation that theirs would be the sole cruise port in the Belize District.

Attorneys for Portico and Waterloo Enterprises addressed the court as interested parties (they were added to the case in December) before Justice Shoman announced she would have an oral decision on Thursday.
