By Aaron Humes: After six years, Gian Espadas of College Street, West Landivar, Belize City, has been found not guilty of possession with intent to traffic 5.46 kilograms – more than 14 pounds – of marijuana.
Espadas, represented by Leeroy Banner, said he had never been in possession of the package found by police at an apartment complex in 2016.
Banner questioned the integrity of police exhibits shown in court, saying that no one can say for sure that the pictures shown in court were of the same parcel police say they found when, it was alleged, a police officer had opened the package on the scene.
Espadas’ testimony said he was taken to the police station in a separate vehicle from the one used to transport the drugs.
Senior Magistrate Aretha Ford, presiding, had initially ruled against a submission of no case to answer, but at the end of the trial after considering the totality of the evidence, found in favour of Espadas not being guilty of drug trafficking.
