By BBN Staff: Police Corporal #434 Kent Martinez has been found not guilty for the 2019 shooting death of Allyson Major.
The verdict was handed down on Monday afternoon. Supreme Court Justice Ricardo O’Neil Sandcroft directed a jury of 9 (3 women and 6 men) to find the accused not guilty of the charge of manslaughter by negligence, following a no case submission by Martinez’s attorney, Oscar Selgado.
He noted that for the Crown to prove manslaughter by negligence a number of things needed to be proven including that the officer owed Major a duty of care, that the duty was breached and that the breach caused Major’s death. He also said that the crown had to prove that the shot that killed Major came from Martinez’s gun, but that “due diligence was not done,” in that area.
“I am not here to speculate. Evidence must be sure so that the prosecution makes you sure,” Justice Sandcroft said.
