Michael Peyrefitte to Governor-General: Collet Montejo must go

By Aaron Humes: Opposition Senator Michael Peyrefitte has written Governor-General Dame Froyla Tzalam requesting she intervene and remove Senator Collet Montejo as Senator on the occasion of him accepting a position as Field Supervisor for the redistricting exercise.

The United Democratic Party has maintained that this is in violation of Section 63(1) of the Constitution, which disqualifies for membership of the House of Representatives and by extension the Senate “by any law by reason of his holding, or acting in, any office the functions of which involve (i) any responsibility for, or in connection with, the conduct of any election; or (ii) any responsibility for the compilation or revision of any electoral register;” and invites the offending Senator to vacate his seat per Section 64 (2) (d).

Peyrefitte told reporters today that Montejo is in a position as part of this exercise while also still Deputy Secretary-General of the People’s United Party to feed valuable information on the process to fellow party officials. Having known and sworn an oath to defend the Constitution, Peyrefitte argued to us, Montejo is indicating that he no longer wants to be a Senator, or else he would have refused the position.

Montejo still has an opportunity to resign and remain a Senator, Peyrefitte concluded, but he and the Government cannot have it both ways. The language of the Constitution also makes clear that Montejo cannot step away temporarily for the duration of the exercise and then return, he added.
