Attorney disputes denial of bail to Julian Henry on manslaughter by negligence charge

By Aaron Humes: Julian Henry, charged with manslaughter by negligence, was denied bail in the Belmopan Magistrate’s Court on Monday despite the Magistrate having the authority to grant bail under law, according to his attorney Richard “Dickie” Bradley.

Bradley told us this evening that his client has a clean criminal record and that per Section 16 of the Crime Control and Criminal Justice Act, manslaughter by negligence is not a charge for which bail can be denied in the first instance as are other crimes classified by that act – murder, attempted murder, robbery or aggravated assault with a firearm, sexual offences, drug possession and trafficking and manslaughter, to name a few.

Bradley compared the case of Henry with another client, Jasmine Hartin, who was charged in similar circumstances with the exception that there were witnesses to what happened at Henry’s Mariposa Street residence in Belmopan last Friday to Daniel Orellano. Those witnesses have given their statements to the police.

But the Magistrate chose not to use her discretion, leaving Henry jailed until he can apply to the Supreme Court for bail as early as Friday, according to Bradley.

The Commissioner of Police Chester Williams referred to the same section, specifically citing subsection 2(i), which lists “an offence under the Firearms Act,” Chapter 143. He did not specify which offence would qualify and Henry was not charged to our knowledge with any other offence than manslaughter by negligence.
