Toledo man given bail as he awaits appeal on sex assault conviction

By Aaron Humes: Bella Vista, Toledo tour guide Dagoberto Garcia was offered bail of $10,000 as he awaits an appeal on his conviction for sexual assault of a minor, 8 years old.

Back in March, Garcia was found guilty of one count of sexual assault by the sitting Magistrate in the Punta Gorda Magistrate’s Court.

The child testified in camera that in June 2022, Garcia kissed her on her cheeks, bit her ears then kissed her on her lips.

Garcia was sentenced to 78 weeks imprisonment.

Attorney Orson Elrington made an application for bail on behalf of his client pending the hearing of his appeal which has been set for October 6, 2023.

The Crown had no objection to either an appeal of the result or bail pending said appeal from the inferior court.

Justice Nigel Pilgrim, presiding, ordered him to report to the Bella Vista Police Starion twice a week, on Tuesdays and Fridays between the hours of 6:00 a.m. and 6:00 p.m. effective next week Tuesday, September 5. He must also attend all his court dates as ordered by the court; he is not to interfere or communicate with the Crown’s witnesses in any way either through a third party or through any social media platform or his bail could be revoked; he is also not to be arrested and charge with any other offenses whilst out on bail.
