By Aaron Humes: 22-year-old Chervin Tench, who managed to beat several firearm and ammunitions cases in September of this year, was not so lucky on a second trial for an empty gun.
Last week Thursday, October 19, he was found guilty of possession of a firearm for an empty 9-millimeter Glock firearm he was seen trying to dispose of by police on May 4, 2022.
In determining the sentence, the court looked at similar cases with similarities to Tench’s with sentences in the range of four to six years’ imprisonment.
Aggravating factors in the case in the view of the court were that he tried to conceal the weapon; the seriousness of the offense and prevalence of the offense.
Mitigating factors the court noted were that Tench had no previous convictions; the firearm was not loaded at the time he was caught with it; no harm was caused during the dicovery of the firearm and it caused no violence to anyone as a result. He also managed to avoid further trouble while out on bail.
The maximum offered was three years and the court settled on 29 months in prison, reduced to 26 months or two years, two months taking into account time on remand.
