Epifania Caliz late to court for arraignment on common assault charge; case adjourned to New Year

By Aaron Humes: The Magistrate’s Court was on the verge of issuing a bench warrant for the arrest of Epifania Caliz, 35, on a simple charge of common assault after she was late to court this morning.

Caliz is accused of deliberately coughing on court reporter Anita Nembhard on October 16, as she was leaving the court’s offices on Coney Drive following an appearance in her case with Elmer Nah, her partner, and Manuel Caliz, her brother – their case would be dismissed three days later with acquittals for all.

The matter was set for 9 a.m., but she was not present. The magistrate then issued a bench warrant and adjourned the matter for December 1. Just at that time, the court was informed that she had just arrived.

Caliz told the court she had vehicle issues and said that was why she was late. Asked why she did not inform the court, she said she was trying to notify the prosecutor but could not get through. So the magistrate told her the court has a number.

She pleaded not guilty and was offered bail of $800 and one surety. She is to reappear in court on January 3, 2024.

Nembhard claims that police gave her the runaround before properly taking her report. Nembhard spoke to reporters, saying she will honor a request that has been made for her to keep her distance from Caliz: “I am very happy that I have finally been able to get through to the Belize Police Department that wrong was done to me. I know that and they are finally able to investigate and bring charges against Epifania Caliz. That was all I was asking for from the beginning. To have to go through so much just for them to hear me, that was unfair.”

She continued that she had heard comments about what others would have done, but as much as she would have wanted to retaliate, she had to think about her family and her job: “If I had reacted how everybody thinks you should react, I would have made my right wrong. The heart that I have, I don’t have that kind of heart, even when wrong was done to me; I knew was to do the right thing. So I thought of my family. I know if Epifania Caliz had thought first of her family she wouldn’t have acted that ugly towards me. I had been covering that story for months.”
