Marlon Everett found guilty of 2018 murder of Albert Johnson

By Aaron Humes: Marlon Everett, 33, has been found guilty of the murder of Albert Johnson which took place on April 20, 2018.

Giving the verdict, presiding High Court Justice Candace Nanton held that the evidence from the Crown, primarily coming from two main witnesses, was enough in her judgment to convict Everett, despite the main witness attempting to change his testimony.

That main witness was 14 years old at the time of the shooting and told police at the time that it was he who handed Everett the gun to shoot Johnson, who was walking ahead of them by a few feet. On the stand he recanted that the statement and gave a different version of events. Nonetheless, his earlier statements were entered into evidence.

However, there was also video surveillance footage introduced into evidence and a police officer was called on to identify Everett as the alleged shooter in the video.

Everett, represented by Bryan Neal, claimed to have been at home with his wife at the time of the shooting which was not far away. He said he heard gunfire and looked out through the window where he could see his neighbours coming out to see what had happened. The next day, he was detained by police and accused of committing the murder.

Senior Crown Counsel Sheneiza Smith prosecuted. Sentencing will take place on January 18, 2024.
