Belize City man claims to have been unlawfully held over minor traffic offenses

Posted: Friday, December 8, 2023. 3:37 pm CST.

By Aaron Humes: A construction worker of Belize City claims his constitutional rights were violated after police detained him for 2 days on two misdemeanor charges for riding a bike without a bell and light, and failed to bring him to court in a timely manner.

25-year-old Josh Nicholson Flowers of Consuelo Street, Belize City nonetheless pleaded guilty to the minor offenses on Thursday.

Police say that on Tuesday, December 5, on Queen Helmet Avenue, Buttonwood Bay area, Belize City he rode a female beach cruiser bicycle without any bell or light.

Flowers told the Magistrate that the police had detained him from Tuesday, and that they were supposed to make sure he attended court on Wednesday December 6 but when they brought him to court, some issue arose and so he was taken back into custody.

But Flowers claimed no Justice of the Peace had further remanded him and so he should not have been made to wait until Thursday to come to court on such a minor offense.

He was fined a total of $50 for both offenses plus cost of court due by December 28.
