Elections and Boundaries refers Concepcion village council issue to Attorney General

By Aaron Humes: Chief Elections Officer Josephine Tamai has informed Chairman of the United Democratic Party (UDP) Senator Michael Peyrefitte that her office is seeking legal advice from the Attorney General concerning the validity of its cancellation of nominations and a by-election to fill a vacant member’s post on the Concepcion Village Council.

On Tuesday, Tamai wrote that upon receiving “very shortly” that legal advice, the Elections and Boundaries Commission (EBC) would formally respond to the UDP.

Before the New Year, Peyrefitte had written to the Commission objecting to allowing Rosalva Moh, who had resigned as a member of the Council to run for chairperson and lost the vote on December 10, then attempted to rescind her resignation two days later.

Nominations and the by-election had been set for January 7 and 14 respectively but were unexpectedly canceled by order of the Department on December 27.

The UDP argues that the cancellation may be “legally erroneous” and challengeable in court.
