Smith was charged with, on Thursday, March 28, at the intersection of the Burrell Boom Road and the Phillip Goldson Highway, intent to put his brother, Robert Ferguson, in fear by uttering the following words to him, “Ah wah kill yuh. Dah des yuh wah dead out yah.”

Smith pleaded guilty but Ferguson took the stand and told the court that he wished to withdraw the matter and not proceed with the case.
