Belize City man pleads guilty to viral video ambush

By Aaron Humes: Former murder suspect Emerson Garnett, 33, today pleaded guilty to a common assault of a man who was apparently lured to a residence by his ex-girlfriend then was filmed being beaten up.

However, the presiding Senior Magistrate questioned the charge levied by the police as the offense committed was a very serious one where he beat up a man and injured him.

Garnett also pleaded guilty to using threatening words to his victim, Mark Avilez.

But the charge was withdrawn, because in law for the offense of using threatening words to be accepted, it had to have been said in the view of the public and the Prosecutor agreed that at the time the words were uttered to Avilez it was said in a private yard and not on the street in any public area.

Garnett was fined $500 and cost of court due by July 4, in default 3 months imprisonment.

The incident occurred on March 30, 2024, but Avilez did not report the matter to police until April 7, a week later.

Avilez said he received a WhatsApp message from his ex-girlfriend asking him to take some food for her. When he arrived at her residence he met two men known to him, one of them identified as Garnett, who made him kneel on the ground, hit him in the face and allegedly threatened to kill him, while his ex recorded the assault on a cell phone.

Garnett previously was acquitted of the murder of Jose Hilario Diaz for which another man with whom he was jointly charged was convicted.
