High Court to hear application on constitutionality of extradition of Nimrod Tillett to Mexico

By Aaron Humes: Speaking exclusively with Breaking Belize News, English barrister Tim Prudhoe revealed this week that proceedings on the extradition of Nimrod Tillett to Mexico in the Magistrate’s Court have been stayed, so that the High Court can hear the defense’s application regarding Tillett’s Constitutional rights.

“The question of whether or not what is happening breaches Mr Tillett’s Constitutional rights has been referred to the High Court. So what will happen next is that the necessary legal papers for that will be filed and there will have to be an argument in the High Court about whether or not the protections that Mr Tillett has under the Belize Constitution will prevent the extradition from going ahead. And essentially, it’s a concern that the treatment that he would receive in the Mexican prison system will pose a serious health risk for him, given that he is himself suffering from injuries he [sustained] last year,” Prudhoe stated in an interview on Thursday.

The defense has raised the issue of whether Tillett can safely travel to Mexico, where he has been wanted since 2019 in the State of Quintana Roo for the murder of a former girlfriend whose body was allegedly stuffed in a trash can. He was shot at as many as 18 times and severely injured in August of 2023 in Corozal Town while visiting another female.

Prudhoe declined to comment on Tillett’s current condition except to repeat that his status is a central part of the coming hearing and that his issues continue as a result of being “badly hurt” and “[nearly dying]” last year.

Prudhoe is an English barrister active in the United Kingdom and the Caribbean, with a base in the Turks and Caicos Islands, where he is a naturalized citizen (he has been a member of the Belize Bar since 2018). He is one of the co-founders of Stanbrook Prudhoe, a TCI law firm specializing in complex and cross-border representation in the Caribbean region. He has appeared in various levels and types of courts, including before the Judicial Committee of the Privy Council, and has over 20 years of experience arguing cases in the Caribbean.
