Nolle prosequi entered in rape case – scant evidence and dead victim allows twice-accused Adam Meighan to go free

By Aaron Humes: A Ladyville, Belize District man twice accused of rape is out free after a court accepted a motion of nolle prosequi against him.

Adam Meighan was accused in December 2018 of accosting and raping a 49-year-old American female who came to Belize as a tourist, but stayed and was a law student taking courses online, living in the Vista del Mar area. The victim died about a year later.

According to the prosecutor, the victim positively identified Meighan as her attacker, but there was no collection of samples for DNA or other evidence that would have allowed the case to proceed without her testimony in the event of her sudden death a year after the incident.

The 49-year-old woman had told police that at around 9:00 a.m., she was leaving her home when a dark-skinned slim-built man walked towards her direction, carrying a rusty machete. The victim said she wasn’t sure if the vehicle she was driving could make it through the road due to the mucky area so she exited her vehicle and went to examine the road.

By this time, the victim said when she turned around, she saw the same man standing 3 feet behind her. The victim said she thought the man was just passing her in the area but that’s when he walked behind her, and with his hand, slammed her upper back and told her to shut up and to stand there. The woman told police that’s when the man pinned her down to the vehicle and raped her.

Justice Derick Sylvester granted the motion. This is the second rape allegation made against Meighan that he managed to walk from.
