By Aaron Humes: Kimane Garbutt, 20, is approaching her 21st birthday and is soon due to give birth.
But the woman known as “Kimmy Boo,” a North Ambergris Caye resident, is tonight remanded to the Central Prison at Hattieville pending meeting bail after being arraigned on a charge of theft.
Garbutt appeared in Magistrate’s Court without legal representation but supported by an officer of the recently renamed Family Support and Gender Affairs Department, formerly the Women’s Department.
Garbutt is accused of, on Tuesday, November 5, in Belize City, dishonestly appropriating various items to a total of $730, the property of Robert Palacio, 52, a musician of Curl Thompson Street, Belize City.
Garbutt initially pleaded guilty to the charge but then the facts were read out in court but she was not in agreement with parts of them.
Garbutt said she and Palacio had agreed for her to hold the items until he paid her boat fare to San Pedro Town. She also denied telling him she had a child and needed money to pay her babysitter.
The Magistrate entered an equivocal plea of not guilty on her behalf and the matter will have to go to trial.
Garbutt was offered bail in the sum of $1,500 plus one surety of the same amount which she had not met as of this evening.
Conditions to her bail is that Garbutt is not to contact or interfere with the virtual complainant or be within 100 yards of him; she is to attend all court adjournments set out by the court and she is not to be arrested and charged for any similar offenses while out on bail.
Garbutt’s next court date is set for January 10, 2025.
Palacio told Police that after meeting via Facebook, she came to the City on November 4 to spend the night and the following morning he agreed to pay her boat fare and the money she asked for to pay her babysitter. But on returning from the bank around 8 a.m. he found her gone and the items missing.
Garbutt turned herself in the next day and was released on police bail.
