Convicted sex offender’s sister pleads for leniency; sentencing delayed

By Breaking Belize News Staff: Jeffery Pott, 35, convicted of three counts of unlawful sexual intercourse with a 13-year-old minor, appeared before Justice Nigel Pilgrim this week for his mitigation plea. The hearing, originally scheduled for last week, was postponed due to the recent death of Pott’s mother.

During the mitigation, Pott’s older sister, Michelle Marie Pott-Brakeman, took the stand and delivered an emotional testimony. She described Pott as their mother’s favorite child, a helpful and caring individual who was always there for his family, particularly during times of grief. She told the court that her brother’s imprisonment had deeply affected their mother, contributing to her recent passing. Pott-Brakeman pleaded for leniency, emphasizing her continued love for her brother.

Pott, who had denied the charges during his trial, claiming he was physically incapable of sexual activity due to a gunshot injury, was found guilty by Justice Pilgrim. The judge discredited Pott’s alibi, finding the testimony of his two alibi witnesses, his estranged common-law wife and a female relative, contradictory and unreliable.

The trial revealed that Pott had engaged in sexual intercourse with the minor on three separate occasions: August 24, 2021; January 2, 2022; and February 20, 2022. Justice Pilgrim, in his ruling, found the minor’s testimony credible and consistent, despite minor discrepancies. He also rejected Pott’s claim that he was unable to have sex, and determined that the alibis provided by the defence were not believable.

Pott, who was unrepresented during his trial, remains remanded in custody. Justice Pilgrim has reserved his sentencing decision until April 8, 2025.
