International News: Court in Barbados strikes out laws banning same-sex acts

Posted: Saturday, December 17, 2022. 9:03 am CST.

By Zoila Palma Gonzalez: Barbados has become the 3rd Caribbean nation to make similar reforms regarding same-sex acts this year, BBC reports.

On Monday, the High Court struck out colonial-era laws that criminalized gay sex.

Members of the LGBTQ community have applauded the move saying that it promoted privacy and freedom.

The Eastern Caribbean Alliance for Diversity and Equality (Ecade) said on Twitter the ruling “consolidates the rights of all Barbadians to privacy and freedom of expression, and impacts LGBTQ+ people across the eastern Caribbean”.

The case was filed by 2 LGBTQ+ advocates in Barbados in partnership with local organizations, including Ecade.

Attorney General, Dale Marshall said that the ruling mean that two sections of the 1992 Sexual Offences Act were unconstitutional.

“In short, [the ruling means] we can no longer prosecute persons under these two sections,” Marshall said.

Courts have also found similar laws to be unconstitutional in Antigua and St. Kitts and Nevis.
