Post-mortem examination yet to be conducted in Vivian Ramnarace death – Is additional murder charge on Elmer Nah likely?

By Aaron Humes: Vivian Belisle Ramnarace died on January 15, two weeks after being shot at her home.

While the accused killer, Corporal Elmer Nah, is behind bars, he has yet to be charged with her murder as an autopsy has not been conducted.

The result of that examination will, Commissioner of Police Chester Williams told reporters today, almost certainly result in upgrading of charges due to a legal process known as “causation.”

Williams, a trained attorney, gave a crash course this afternoon in exactly what that means: “There must be a causal link between the act perpetrated by the accused and the death of the individual person. If that causal link is broken, then the accused cannot be held to be liable. Once it can be proven that the operational and substantial cause of death is as a result of the gunshot injuries she sustained, the perpetrator is still liable.” And that, he states, extends to any claim of medical malpractice.

There are reports that Ramnarace died following a heart attack caused by a blood clot. While this has not been established, a “test of necessity” must be passed to be clear as to what caused the death. As Williams expressed it, “Had it not been for the gunshot injury she sustained at the time by the accused person, she would not have sustained the blood clot and heart attack and he is still liable.”

Whatever the results, Williams concludes, he is reasonably sure there has been no break in the chain and the charges, which Nah denies, will most likely be upgraded.
