Convicted rapist Andre Gordon handed 16 years in prison, must serve at least half of the term for parole

By Aaron Humes: Six months after his conviction on a charge of rape, 37-year-old Andre Gordon was told that he must serve 13 years and six months in prison on a 16-year term.

Presiding Justice Ricardo O’Neil Sandcroft, who found Gordon guilty last July, broke down the sentence as follows: an initial term of eight years, the minimum under law, and a further eight years due to multiple aggravating factors. He then deducted time for mitigating factors, including a positive social inquiry report and good character testimony, as well as time served on remand and first-time offender status, reducing the initial term by two and a half years.

Justice Sandcroft further ruled that Gordon cannot be considered for parole before serving a full eight years of his prison term for a “heinous crime.”

Gordon could have gotten as much as life in prison, but he had not been convicted of any offence before this charge. His character witnesses told the court that this incident was well out of character for someone they said they knew well for so long.

The victim, 21 at the time of the incident in February of 2017, told the court at trial that she met Gordon at her home after a night out, who told her that he was checking to see that she had reached home safely. After dozing off, she awoke to find Gordon on top of her, trying to turn her over. She testified that she fought him and asked why he was doing this to her, which caused him to get up and leave.

Gordon gave sworn testimony that he had agreed to consensual, vaginal intercourse and that she later claimed to be raped because she professed to be lesbian.
